We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from us.

SECTION 3 – ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION.

We are not responsible if information made available on this site is not accurate, complete, or current. You agree that it is your responsibility to monitor changes to our site.

SECTION 4 – BOOKING AND PAYMENT.

Prices for our apartments are subject to change without notice. We reserve the right at any time to modify or discontinue the Service without notice.

SECTION 5 – CANCELLATION AND REFUND POLICY (GUEST BOOKINGS).

Our cancellation policy for guest bookings is as follows:

By default, we do not offer refunds once payment is received and we have confirmed the booking. However, in cases where we are unable to host a guest due to a fault arising at our end, we will issue a full refund equivalent to the number of unspent nights.

We initiate eligible caution fee refunds within 24 hours of checkout, processed to the same account or card that initiated the payment. Depending on the user’s bank, it may take up to 10 business days for refunds to reflect in a customer’s account. We are not liable for any delay in this process.

Please note that we do not pay interest on caution fees during the refund process.

SECTION 6 – SMOKING POLICY.

Smoking is allowed but with moderation and no damage to any of our facilities – sofas, tables and any other items in our apartments. Caution Deposits will be forfeited and if value of damaged items exceeds deposited caution fee, the difference will be required to be covered. 

SECTION 7 – ACCURACY OF BOOKING AND ACCOUNT INFORMATION.

We reserve the right to refuse any booking you place with us. You agree to provide current, complete, and accurate booking and account information for all reservations made on our site.

SECTION 8 – PROPERTY LISTING ADVERTISING PROGRAM.

8.1 Nature of Service: Otashortlets.com.ng operates an advertising platform that allows property owners and authorized representatives (“Listers”) to submit listings for short-term rental properties. By submitting a listing, you acknowledge that Otashortlets.com.ng is solely providing an advertising service and is not a real estate agent, property manager, or booking intermediary.

8.2 Advertising Fees – Non-Refundable: All payments made to Otashortlets.com.ng  for listing advertising services are strictly non-refundable under all circumstances. This includes but is not limited to:

• Listings that are rejected, suspended, or removed for any reason
• Listings that receive minimal views, clicks, or bookings
• Listings with inaccurate, incomplete, or fraudulent information
• Listings that violate these Terms of Service
• Changes in market conditions or property availability
• Dissatisfaction with the service or results
• Technical issues, platform downtime, or service interruptions
• By submitting payment for listing advertising, you expressly waive any right to request a refund, chargeback, or reversal of payment for any reason whatsoever.

8.3 No Performance Guarantees: Otashortlets.com.ng makes absolutely no representations, warranties, or guarantees regarding:

• The number of views, impressions, or clicks your listing will receive
• The number of booking inquiries or confirmed reservations
• The ranking or placement of your listing in search results
• The duration your listing will remain visible or active
• Revenue, occupancy rates, or financial returns from your listing
• The quality or legitimacy of potential guests viewing your listing
• You acknowledge that listing performance depends on numerous factors beyond our control, including market demand, pricing, property quality, location, seasonality, and competition.

8.4 Listing Accuracy and Lister Responsibility: By submitting a listing, you represent and warrant that:

• All information provided is truthful, accurate, complete, and current
• You have legal authority to list the property (as owner or authorized representative)
• The property exists and is available for short-term rental
• All photos, descriptions, amenities, and features accurately represent the property
• You possess all necessary permits, licenses, and approvals required by law
• The property complies with all applicable health, safety, and housing regulations
• You will promptly update listing information if any details change
• You are solely responsible for the accuracy of your listing. Otashortlets.com.ng does not verify, validate, or investigate listing information and expressly disclaims any responsibility for inaccurate, misleading, or fraudulent listings.

8.5 Fraudulent Listings – Complete Disclaimer of Liability: Otashortlets.com.ng shall have no liability whatsoever for fraudulent, deceptive, or misleading listings submitted by Listers, including but not limited to:

• Properties that do not exist or are not available for rental
• Unauthorized listings submitted without property owner consent
• Misrepresentation of property features, condition, or location
• Use of stolen, fake, or misleading photos
• False identity verification documents
• Scams, fraud, or criminal activity perpetrated through listings
• All disputes, claims, or losses arising from fraudulent listings are exclusively between the Lister and affected third parties. Otashortlets.com.ng is not a party to any such disputes and assumes no responsibility for investigation, mediation, or resolution.

8.6 Listing Approval and Rejection: Otashortlets.com.ng reserves the absolute right to:

• Approve, reject, suspend, or remove any listing at any time for any reason or no reason
• Modify or edit listing content, photos, or descriptions without notice
• Require additional verification, documentation, or payment proof before approval
• Impose listing quality standards, content guidelines, or photo requirements
• Delist properties that violate these Terms or applicable laws
• Terminate Lister accounts for violations or suspicious activity
• No refunds will be provided for listings that are rejected, suspended, or removed, regardless of reason.

8.7 Payment Proof Requirements: Listers must submit valid proof of payment (bank transfer receipt, transaction confirmation, or other acceptable documentation) for each advertising period. Otashortlets.com.ng reserves the right to:

• Reject payment proofs that are unclear, incomplete, or suspected to be fraudulent
• Request additional verification or alternative payment documentation
• Suspend or remove listings with unverified or rejected payment proofs
• Investigate payment irregularities or suspected fraud
• Submission of payment proof does not guarantee listing approval or activation. All advertising fees remain non-refundable regardless of payment proof approval status.

8.8 Listing Duration and Renewal: Listing advertising periods are defined by the duration specified at the time of payment. Otashortlets.com.ng is under no obligation to provide advance notice of listing expiration. It is the Lister’s sole responsibility to:

• Track listing expiration dates
• Submit renewal payments and payment proofs before expiration
• Ensure continuous listing visibility through timely renewals

While courtesy reminder emails may be sent, Otashortlets.com.ng makes no guarantee that reminders will be delivered or received. Failure to receive a reminder does not excuse late renewal or entitle Listers to retroactive extensions or refunds.

8.9 Lister Indemnification: You agree to indemnify, defend, and hold harmless OtaShortlets.com.ng, its owners, officers, employees, contractors, and affiliates from any and all claims, demands, lawsuits, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

• Your listing content, photos, descriptions, or representations
• Inaccurate, misleading, or fraudulent listing information
• Unauthorized listing of properties without owner consent
• Violations of intellectual property rights (photos, content, trademarks)
• Guest disputes, injuries, property damage, or criminal activity
• Non-compliance with local laws, regulations, or permit requirements

Breach of these Terms of Service

Any third-party claims arising from your use of the listing service

8.10 Platform as Advertising Service Only: You expressly acknowledge and agree that:

• Otashortlets.com.ng is solely an advertising platform, not a property manager or booking agent
• Otashortlets.com.ng does not facilitate, process, or collect guest booking payments
• All guest interactions, bookings, and payments occur exclusively between Listers and guests
• Otashortlets.com.ng has no involvement in rental agreements, guest disputes, or property operations
• Otashortlets.com.ng is not responsible for guest conduct, property damage, or safety issues
• Listers are solely responsible for property maintenance, guest services, and legal compliance

SECTION 9 – INDEMNIFICATION AND LIABILITY DISCLAIMER (GUEST BOOKINGS).

You agree to indemnify, defend, and hold harmless Otashortlets.com.ng and our affiliates from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms of Service.

By booking our apartments, you further agree that Otashortlets.com.ng, its affiliates, and its team shall not be held liable for any loss, damage, injury, or harm, including but not limited to theft, bodily harm, fire, accidents, injuries, electrical faults, or any other incidents that may occur during your stay or that of your guests.

This indemnification extends to all losses, liabilities, claims, expenses, fees (including attorney fees), fines, penalties, damages, and costs arising from or in connection with your use of our apartments.

By booking our apartments, you acknowledge and agree to assume all risks associated with your stay and understand that Otashortlets.com.ng shall not be held responsible for any incidents or occurrences beyond our control.

SECTION 10 – LIMITATION OF LIABILITY.

To the maximum extent permitted by applicable law, Otashortlets.com.ng shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from or related to:

• Your use or inability to use the platform or listing services
• Listing performance, visibility, views, clicks, or booking results
• Fraudulent, inaccurate, or misleading listings submitted by third parties
• Platform downtime, technical errors, or service interruptions
• Guest disputes, property damage, injuries, or criminal activity
• Reliance on listing information or platform content

In no event shall otashortlets.ng total aggregate liability exceed the amount paid by you for listing advertising services in the twelve (12) months preceding the claim.

SECTION 11 – GOVERNING LAW AND DISPUTE RESOLUTION.

These Terms of Service shall be governed by and construed in accordance with the laws of The Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Ogun State, Nigeria.

You agree to first attempt to resolve any disputes through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act of Nigeria.

SECTION 12 – SEVERABILITY.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

SECTION 13 – CHANGES TO TERMS OF SERVICE.

We reserve the right to update, change, or replace any part of these Terms of Service at any time by posting updates to our website. It is your responsibility to check these Terms periodically for changes. Your continued use of the platform after changes are posted constitutes acceptance of those changes.

SECTION 14 – ENTIRE AGREEMENT.

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Otashortlets.com.ng and supersede all prior agreements, understandings, or representations regarding the subject matter herein.
